FTC order directing Intuit to stop deceptive TurboTax ads thrown out by US court

A U.S. appeals court has invalidated an FTC order that barred TurboTax maker Intuit from advertising its software as “free” when not all taxpayers were eligible. The 5th U.S. Circuit Court of Appeals ruled that the FTC violated the constitutional separation of powers by having an administrative law judge decide deceptive advertising claims. The matter has been returned to the FTC for further proceedings, with Intuit maintaining its advertising has always been clear and transparent.
